These terms apply to students and members of the public referring friends and family through our Refer a Friend scheme.
1. Introduction
1.1 Omega Partners Ltd is a company registered in England and Wales under company number 13264110, with its registered office at International House, 10 Beaufort Court, Admirals Way, London, England, E14 9XL (“Omega Partners”, “we”, “us” or “our”).
1.2 These Terms and Conditions apply to any individual (the “Referrer”) who submits a referral of a prospective student (the “Student”) to Omega Partners via our referral page at www.omegapartners.co.uk/referral.
1.3 By submitting a referral, the Referrer confirms that they have read, understood and agree to be bound by these Terms and Conditions.
2. Referrals and Student Eligibility
2.1 Referrers must ensure that all Students referred to Omega Partners have a genuine, bona fide intention to undertake and complete a full university-level course of study for the purpose of improving their long-term career prospects.
2.2 Students must be willing and able to:
- attend all required classes (typically a minimum of two days per week);
- submit all required academic assessments (normally six assignments per academic year, or two per semester); and
- comply fully with the academic, attendance and conduct requirements of the relevant institution.
2.3 Referrers must not knowingly refer Students who are unlikely to engage meaningfully with the academic programme, who intend to withdraw prematurely, or who may seek to misuse student financial support systems.
2.4 Self-referrals are permitted for application purposes, but no referral fee, bonus, reward or other payment shall be due or payable where the Referrer and the Student are the same person, and a self-referral does not count towards the bonus in clause 5.4.
3. Fraudulent or Misleading Referrals
3.1 The referral of Students who do not genuinely intend to complete their course of study, or who enrol primarily to access maintenance loans or other financial support without genuine academic intent, may constitute fraud or other criminal offences under UK law.
3.2 Omega Partners reserves the right to report suspected fraudulent or misleading conduct to the relevant university, funding body (including Student Finance England), or regulatory or law enforcement authority.
3.3 Omega Partners accepts no liability for any legal, financial or regulatory consequences arising from the conduct of referred Students or Referrers.
3.4 Students must not be charged a fee by any party, including Omega Partners, the Referrer or any third party, in connection with the referral. Where a Student reports that a fee has been charged, this agreement shall terminate immediately in respect of that referral.
4. Discretion to Decline or Withdraw Referrals
4.1 Omega Partners reserves the right, at its sole and absolute discretion and without obligation to provide reasons, to:
- decline any referral;
- cease working with any Referrer or Student; or
- withdraw from a referral at any stage.
4.2 This includes circumstances where Omega Partners determines that the Student has not demonstrated genuine academic commitment or ongoing engagement.
5. Payment Terms
5.1 A referral payment is only payable where:
- the Student successfully enrols with a university introduced by Omega Partners;
- the Student begins class attendance and remains actively engaged;
- the Student is not subject to any academic, disciplinary, compliance or fraud concerns; and
- Omega Partners has first received payment in full from the relevant university in respect of that Student.
A Student who meets all of these conditions is a “Qualifying Referral”.
5.2 Subject to clause 5.1, the Referrer shall be entitled to one fixed referral payment of £250 for each Qualifying Referral.
5.3 The £250 referral payment is a single payment per Student. Apart from the bonus in clause 5.4, no staged, partial, interim or additional payments shall be due in respect of that Student.
5.4 Five-referral bonus. When five of the Referrer’s referrals have each become a Qualifying Referral, the Referrer shall be entitled to a one-off bonus of £1,000, in addition to the £250 paid for each of those five Students. The bonus is paid once Omega Partners has received payment from the relevant university in respect of the fifth Qualifying Referral.
5.5 Payments will only be made after Omega Partners has received payment from the relevant university partner. This usually occurs approximately three to four months after the Student begins class attendance, but timing may vary depending on the university’s reporting and payment cycle.
5.6 No payment shall be due unless and until Omega Partners has received the corresponding funds from the relevant university.
5.7 Omega Partners shall not be liable for any delay or failure to make payment caused by delayed, reduced, disputed or non-payment by the relevant university.
5.8 Omega Partners reserves the right to withhold, reduce or cancel any referral payment or bonus where it reasonably suspects fraud, misrepresentation, bad faith, breach of these Terms or non-genuine student intent.
5.9 Omega Partners reserves the right to amend referral payment amounts, the bonus or payment schedules at any time. Changes apply to referrals submitted after the updated Terms are published. Referrers are responsible for reviewing the latest version of these Terms.
6. Data Protection and Confidentiality
6.1 All referral data shall be processed in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
6.2 Referrers must obtain the informed consent of each Student before submitting personal data to Omega Partners.
7. Amendments
Omega Partners may amend these Terms and Conditions at any time by publishing an updated version on its website. Continued use of the referral platform constitutes acceptance of the amended Terms.
8. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any dispute arising in connection with these Terms.
